1. Agreement to these terms

These Terms & Conditions ("Terms") govern your use of clearballistics.com (the "Site") and any purchase from Clear Ballistics LLC ("Clear Ballistics," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from us. If you order on behalf of an agency, company, or other organization, you confirm you are authorized to bind it to these Terms.

3. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us right away at info@clearballistics.com if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

By creating an account, you agree to receive marketing emails from Clear Ballistics. You can unsubscribe at any time using the link in any marketing email. See our Privacy Policy for details.

4. Products and descriptions

We work to describe our products accurately, including dimensions, weights, and calibration information. Our 10% ballistic gel is manufactured to FBI BB Calibration Specs, and our 20% ballistic gel is manufactured to NATO BB calibration specs, as stated on each product page. Individual test results depend on conditions outside our control, including temperature, storage, handling, remelting, firearm, ammunition, and test setup. Colors and appearance may vary slightly from photos.

Product images are for illustration. For accessories and third-party items, such as cookers, molds, and cases, we may fulfill your order with a different brand or model of similar function and appearance to the one pictured.

5. Orders, pricing, and payment

• All orders are subject to acceptance and availability. We may refuse or cancel any order, including orders that appear fraudulent or that we cannot legally ship.
• Prices are in US dollars and may change without notice.
• Pricing and calculation errors. If a product is listed at an incorrect price, or our cart or checkout calculates your total incorrectly, we may correct the error at any time, including after your order is accepted or shipped. If this happens, we will contact you and either (a) ask you to pay the difference, (b) cancel the order and refund the amount you paid, or (c) if the order has shipped, send you a prepaid return label and refund the amount you paid once we receive the item. If you do not agree to pay the difference, we will use option (b) or (c).
• Taxes and shipping charges are shown at checkout. Tax-exempt customers must provide valid documentation before the order ships.
• By submitting payment, you confirm you are authorized to use the payment method.
• By placing an order, you agree to receive marketing emails from Clear Ballistics. You can unsubscribe at any time using the link in any marketing email. See our Privacy Policy for details.

6. Shipping

We ship to customers in the United States and internationally. Processing and delivery times are listed on our Shipping & Returns page and are estimates, not guarantees. Title and risk of loss pass to you when we deliver the order to the carrier. For international orders, you are responsible for duties, taxes, customs fees, and compliance with import rules in your country.

7. Returns and refunds

Returns, refunds, and exchanges are governed by our Shipping & Returns policy, which is part of these Terms. In summary:

• Unused products in original packaging may be returned within 30 days of purchase for a refund, minus a 10% restocking fee, issued to the original payment method within 7 business days of receiving the return.
• Between 30 and 60 days, unused products may be exchanged for another Clear Ballistics item. No refunds after 60 days.
• Original and return shipping costs are non-refundable unless we shipped the wrong item. You are responsible for items lost or damaged in return transit, so use tracking and insurance.
• Report damaged or defective merchandise within 5 calendar days of delivery.
• Products that have been shot, remelted, or otherwise used are not eligible for return.
• Products bought from an authorized retailer follow that retailer's return policy.

8. Intended use and safety

Our products are designed for terminal ballistics testing, training, research, education, and demonstration. You agree to:

• Use our products only in compliance with all applicable laws, including firearms laws and range rules
• Follow safe firearm handling practices and use appropriate eye, ear, and personal protection
• Always know your target and what is beyond it. Our products are not designed to stop bullets and should never be used as a backstop.
• Follow our published instructions for storage, handling, and remelting, including the recommended limit of up to 10 remelts
• Never use our products for any unlawful purpose or to harm any person or animal

Remelting involves high temperatures and hot material that can cause burns or fire. Use proper equipment, ventilation, and supervision.

To the fullest extent permitted by law, Clear Ballistics is not responsible for any injury, death, loss, or damage that results from failing to follow these requirements, from misuse, or from using our products for anything other than their intended purpose.

9. Export and international orders

You agree to comply with all US export control and sanctions laws and the import laws of your country. We may refuse or cancel orders to restricted destinations, parties, or end uses.

10. Warranty disclaimer

Except for any express limited warranty stated on a product page or in writing from us, our products and the Site are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any product will produce a specific test result or that the Site will be uninterrupted or error-free.

11. Assumption of risk

Firearms testing and remelting carry inherent risks, including serious injury, death, and property damage. You acknowledge these risks and assume full responsibility for how you use our products, including the firearms, ammunition, equipment, and test environment you choose.

12. Limitation of liability

To the fullest extent permitted by law, Clear Ballistics and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these limits, so some may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Clear Ballistics and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use or misuse of our products, your violation of these Terms, or your violation of any law or the rights of others.

14. Intellectual property

All content on the Site, including text, images, videos, logos, product designs, the Clear Ballistics name, and the "See what you shoot." tagline, is owned by or licensed to Clear Ballistics and protected by intellectual property laws. You may not copy, reproduce, or use it for commercial purposes without our written permission.

15. Reviews, submissions, and social media

If you submit reviews, photos, videos, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with our business. You confirm you own the content and that it does not violate any law or third-party rights. We may remove any submission at our discretion.

If you tag Clear Ballistics, mention us, or use our hashtags, such as #SeeWhatYouShoot, in a public social media post about our products, you grant us permission to reshare that post, with credit to you, on our website, social media, and marketing. You can ask us to remove a reshared post at any time by contacting us.

16. Third-party links and retailers

The Site may link to retailer, partner, and social media sites we do not control. We are not responsible for their content or practices. Purchases made through authorized retailers are subject to that retailer's terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in Greenville County, South Carolina, and you consent to their jurisdiction.

18. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Site after changes means you accept the updated Terms.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and Shipping & Returns policy, are the entire agreement between you and Clear Ballistics regarding the Site and your purchases.
